What the court describes

  • Both spouses file together rather than one spouse starting the case against the other.
  • The spouses agree on finances, property and, when applicable, parenting and support terms.
  • Separate required packets exist for cases with children under 21 and cases without children under 21.
  • The official forms were revised March 1, 2026.

Confirm the official requirements

  • A previously started divorce action may affect whether this path can be used.
  • Additional forms may be required depending on the situation and county.
  • Agreement does not remove every legal, financial, property, pension, tax, parenting or safety issue.
  • Use the current court packets and ask the court or a lawyer about uncertainty.
Compare before choosing a form path: New York Courts also publishes a standard uncontested-divorce packet, a DIY program for certain cases, and contested-divorce forms. Do not substitute one packet for another based only on the title.
